Ft. Hood Shooting Rampage Reviewed

It's been over a week since I returned from Ft. Hood. That's right I was at Ft. Hood a week ago Thursday when Nidal Hasan decided to go on a shooting rampage against his fellow soldiers. It's taken me this long to process things and decide to write them up.

A group of us were finishing up a meeting when all the cell phones of the local folks started ringing. That was the first indication that something was happening. Shortly thereafter we got word that there had been a shooting on base and that the base was in lock-down. We spent the next five plus hours locked in the building not really knowing what was happening.

Information was in short supply most of that afternoon. Indications were that there were multiple shooters, that one was dead, that one or two were in custody, and that one or two were still at large. Multiple shooting locations were mentioned. Early on it was even said that there was a possible sniper. All the while the tally of dead and wounded went up, and those of us locked in continued in tension and uncertainty.

We tried to get some work done to wrap up from our meetings that week. It was not very productive due to the nervousness of not knowing what was happening. The cell phone networks were overloaded. Text messaging worked and some of us could hit the Web from our phones, but we did not have a computer network connection, TV or radio for information. And frankly there was not much information out there to be had. I did get a message or two off to my wife letting her know that I was OK, but it was early evening before any cell phone calls would start going though and I was able to talk to her.

By early evening we had learned the name of the thought-to-be-primary shooter. It was quite a shock that it was of their own. We also had final tallies of the dead and wounded, that too was a shock.

At 7:15pm local time lock-down was lifted. Next was the trial of getting off-base with many thousands of other people trying to do the same thing at the same time. It took us over 2 hours. After that was a quick stop for something to eat and a 90 minute drive Austin. All-in-all a very long, tiring day.

Looking back it was fortunate that we were as far from the shooting location as we were, about two and half miles. And as far as I know none of the people killed or wounded were connected to the people that were were meeting with. Still it was not a fun experience and actually there was quite e bit of nervousness and tension from not knowing what was happening.

Regarding the shooter IMNSHO he is the worst of mass murderers. He needs to be tried, convicted, sentenced to death and have his sentence carried out in a prompt manner. I also think the Army, and the probably the rest of the military, needs to re-examine their attitudes and practices related to Muslim service members. I'm not saying that they should receive extra scrutiny, but quite clearly signs were missed because of hyper-concerns about appearances of religious persecution. If someone is not performing, or showing signs of agitation and concern, that needs to be dealt with directly and not skirted because of the person's religion.

Furthermore, people should be allowed to carry guns for personal protection on military bases. There were hundreds of trained people in close proximity who could have made short work of Nidal Hasan and potentially saved the health and lives of some of their fellow soldiers if they were allowed to carry on base. Sadly this is yet another example demonstrating that victim disarmament zones do not work.

Alabama Tragedy

I'm sure most have heard about this by now. If not here's a page with links to stories about this tragic event.

Today I came across an article with more info on this tragedy: Town comedian hailed as hero in Alabama killings
On Friday, witnesses and authorities said Maloy, the 10th and final victim of Tuesday's shooting rampage by Michael McLendon, single-handedly tried to end the violence with his beat-up old pickup truck.

With gunshots still echoing through downtown Samson and the killer headed toward a bigger city 12 miles away, Maloy chased McLendon's dark red Mitsubishi out of town, ramming the vehicle at least once.

Maloy slowed down the killer briefly, and he may have given police and state troopers time to catch up to McLendon, said Geneva County Chief Deputy Tony Helms. But it cost him his life.
Stories like this make me wish more people could and would carry.

On a larger front, is it me or have there really been more news reports of people committing crimes with guns in the last few weeks since AG Holder announced his idea for a new weapons ban? I would be quite interested in any studies that have been or are being done that show or disprove any correlation between the reporting of gun-involved crimes and gun control-related announcements. I'm not claiming there are any conspiracies, but I also do not believe much in coincidence.

While I believe my base class to include this right as well, the state has thus far overloaded the 2A operator with a null pointer... As of yet the linter has not detected this and a segfault is occurring when the function is referenced...

The Rat Resurfaces

The rat that is Northeast Traders resurfaces again:
It seems that while every store in the state sells them. They are not on the approved Roster. I came into work last night to find them all locked up back in the cage.

It seems someone came into the store, I was told, on Saturday to return a 22A that he bought from Bass Pro.

From what I was told yesterday by several different people...

He went into Northeast Trading and was talking about the 22A he bought from Bass Pro. He was told by someone there that it was a felony to own the pistol, and he needed to take it back.

So, he came back on Saturday, as I posted above, and was freaking out that he was going to go to Jail and demanded that we take it back.

So, we took it back, we removed them from the shelves.
As I've said before with regard to their history, Northeast Trading is a lying, scum of the earth dealer who is an enemy of gun owners in Massachusetts and should be boycotted by us all. Just so you know who he is here is the address and contact information:

Obama's Continued Dissimulation

I've written about this before, but a quote I read in an article from yesterday has energized me to revisit this issue. Previously I had examined his statements relative to his past actions. Today I'd like to compare his campaign rhetoric to his published issue positions.

Here's what the Obamanator said recently as reported in "Working for the Working Class Vote":
“I just want to be absolutely clear, O.K.? I just don’t want any misunderstanding when you all go home and you talk with your buddies, and they say, ‘Oh, he wants to take my gun away.’ You heard it here, and I’m on television, so everybody knows. I believe in the Second Amendment. I believe in people’s lawful right to bear arms. I will not take your shotgun away. I will not take your rifle away. I won’t take your handgun away.
Here is what his official issue position says on the same topic:
As president, Barack Obama would repeal the Tiahrt Amendment, which restricts the ability of local law enforcement to access important gun trace information, and give police officers across the nation the tools they need to solve gun crimes and fight the illegal arms trade. Obama and Biden also favor commonsense measures that respect the Second Amendment rights of gun owners, while keeping guns away from children and from criminals who shouldn't have them. They support closing the gun show loophole and making guns in this country childproof. They also support making the expired federal Assault Weapons Ban permanent, as such weapons belong on foreign battlefields and not on our streets.
This is gun control bigger, better, more wonderful. A new AWB would be much more encompassing than the old one as its proponents have vowed to close the kind of loopholes that were in the old one. "Childproof" is an gun-ban code word for various proposed smart locks and individually coded interlocks that are fundamentally flawed in various ways. No such guns exist in the marketplace nor will they given their flaws. Closing the gun show loophole effectively means the end of private party sales driving up prices and enabling further gun control via dealer regulation.

His Tihart amendment position is flat out based on falsehood. Law enforcement does have access to all the gun trace information they need to trace guns used in crimes. What they, and this is primarily the BATF, do not have now is access to gun trace information for the purposes of harassing law abiding citizens, confiscation, dealer and manufacturer lawsuits and other anti-2A purposes.

I will grant that nothing in his position statement absolutely states that existing guns will be taken away from people, but making guns child-proof and reinstating the AWB would make the possession of certain guns illegal. The unanswered question is whether all of his gun control measures would contain grandfather clauses to "protect" existing owners. Without "grandfather" clauses his proposed legislation would make criminals of existing gun owners. I'm not willing to bet on that, particularly with regard to the AWB.

What is worse is what he does not say. According to his stated position American would no longer be able to buy many types of handguns, rifles and even shotguns that can currently be bought. People who have guns now likely would be able to keep them, but few new ones could be bought. Imagine a country where our children will be subject to a declining and increasing expensive number of firearms to protect themselves and their rights. And of course, criminals will always be able to get guns because they do not abide by the laws intended to restrict their acquisition of guns.

I continue to conclude that Obamarama is a liar in intent if not in letter. We've seen Joe The Plumber take him on regarding taxes. Now we need a Billy The Hunter to ask the same kind of hard question regarding the 2nd Amendment.

McCain Hits a Home Run

A grand slam even, with his selection of Sarah Palin as his running mate. Her selection energizes the conservative party base, steals some Clintonista PUMAs, adds some experienced youth to the ticket,and plays wack-a-mole with Obamarama's post-convention media and polling bump. For those that cry she is inexperienced I would point out that she has years more executive and governing experience, infinitely so actually, than Obamarama and Loose-Lips together!

I hereby designate McCain with a new moniker. No longer will he be known as "Cheap Talk"; now I will refer to him as Has-a-Brain McCain.

I'm still working on a good name for Sarah Palin. This will do for the moment, but I'm sure a better one will emerge soon.

2A Rights in Massachusetts

Another legislative season has come to a close in MA. Here's a summary of RKBA-related bills courtesy of GOAL (see this page for full details):
  • Governor's Fee Increase - The Governor's proposal to increase firearm license fees was defeated thanks to the quick action of Rep. Denis Guyer in filing an amendment to remove the increased fees from the bill...
  • SCOTUS Resolution - The senate decided not to take part in the resolution offered by Rep. George Peterson recognizing the Heller decision and so it was offered as a House resolution only. The resolution was amended to remove the references to Article XVII of the Massachusetts Constitution because the U.S. Supreme Court didn't rule on that matter. After being amended, the House voted 115 - 40 to approve the resolution! A very strong showing for the recognition of the Second Amendment Ruling.
  • S.1401 - GOAL's version of the Katrina bill filed by Senator Richard Moore was passed in both the Senate and the House and is waiting final enactment prior to going to the Governor's desk. This final step can normally happen in an informal session and should be completed next week. Another great victory for lawful gunowners.
  • H.3991 The Governor's Lawful Citizen's Imprisonment Act - Thanks to the efforts of our members contacting the Joint Committee on the Judiciary, the Governor's H.3991 bill never left the Committee and was thus defeated for the legislative session.
Overall well done, at least in not losing ground, and taking back a few hillocks. Hopefully with the Heller decision to build on more can be done in coming sessions.

How I spent the 4th

Actually most of the week was spent working on a new buck shed for the goats. Here's the progression:

First, I had to move the old 8'x8' shed out of the way by turning it 90 degrees and moving it ~20 feet to it's new temporary location. The skid-steer I rented was very helpful in skidding it around. It came through mostly intact.
Then, I had to build up a platform for the new shed with ~7 yards of stone dust to keep it from flooding out during heavy rains. This is the real reason I rented the skid steer, and what I spent the least amount of time using it for.

Finally came construction, starting with the base built from 4x4 and 1x8 pressure-treated lumber.

And this is how it ended up Sunday evening, framed out but with roofing, sheathing, doors, windows, etc. yet to be done.

Also, I used the skid steer to clean out a section of overgrown brush, and redistribute another 7 yards of crushed base on the driveway.

Of course on the 4th of July I had to do some kind of fireworks. This year it consisted of meeting +100 other people at the Shirley Rod and Gun Club for 4 hours of gun fun.
All in all a very enjoyable week.

It's About Time

Supreme Court Strikes Down D.C. Gun Ban, Upholds Individual Right to Keep and Bear Arms
"Writing for the majority, Justice Antonin Scalia said that an individual right to bear arms is supported by "the historical narrative" both before and after the Second Amendment was adopted."
Some are saying that one of the unanswered questions is whether this ruling incorporates the 2nd Amenedment against the states. Some claim it did not, but other analysis indicates it rather clearly does. My reading leans toward the later.

The question now is what effect this will have on now unconstitutional gun control rules and regulations in various cities and states, and when. Here are the Massachusetts laws that I think could and should be affected and invalidated by this ruling:
  1. Assault Weapon Ban (C.140: S. 131M):
  2. "Consumer Protection"-based Handgun Ban (C.140: S. 123)
  3. Discretionary and Restrictive Licensing (C.140: S. 131)
  4. Mandatory Locks for Sales (C.140: S. 123)
  5. Mandatory Storage (C.140: S. 131L)
  6. Transportation Restrictions (C.269: S. 12D, C.140: S. 131C (a), (b), C.140: S. 121, C.269: S. 10 (m), , C. 140: S. 131C)*
Bottom line is that this ruling should lead to nationwide "shall-issue" or "no license required" policies, the abolishment of locked storage and transportation laws, and repeal of all AWBs and other bans of specific types of non-NFA firearms. We shall see if and how long this takes. I suspect some places, like Massachusetts, will take further legal action to bring this ruling into force.

The last question is "How could 4 justices dissent?!?" Clearly gun control is a matter of ideology bordering on religion for them, not law. Sad.

Getting the Lead Out, Riiiight

I apologize up front for the length of this post, but proposed legislation like this deserves to get torn to pieces line by line.


Two Massachusetts legislators have proposed feel-good legislation to eventually outlaw a variety of "toxic substances". One of those substances is lead, as in the lead used in bullets, or wheel weights, or batteries, or ...

This is a very bad bill, but some people are claiming that the NRA and others are chicken-littles based on responses from 2 of the sponsors of this bill. These responses are posted here:

Both responses claim that this proposed bill is no threat to hunters and shooters because it will not affect lead ammunition or shooting ranges and that it has "no teeth". Both responses are factually incorrect on their substantive points to the point of deliberate mis-information.

So, let's look at the actual bill to debunk these replies and illuminate the dangers. I'll use the House version, but a quick look through the Senate version showed no major differences:
First, there is the false assertion that it will not affect ammunition or ranges where said ammunition is present. Here's the definition of the initial "priority toxic substances":
60 “Priority toxic substance” means any of the following sub
61 stances:
62 Lead
63 Formaldehyde
64 Trichloroethylene
65 Perchloroethylene
66 Dioxins and Furans
67 Hexavalent chromium
68 Organophosphate pesticides
69 Polybrominated Diphenyl Ethers
70 di-(2-ethylhexyl)phthalate (DEHP)
71 2,4, Dichlorophenoxyacetic acid (2,4, D)

This is the classic list of stuff that can be dangerous to people if they misuse it so the state must protect us from them. Note that there is no exemption for any forms of lead. Lead is Lead.

Here is the definition of "used". Note that the presence of said chemicals in services is included:
109 “Usage” means the presence of a priority toxic substance in
110 manufacturing, products or services delivered or conducted within
111 the Commonwealth.
Ranges provide a service. Lead is present as part of the conduct of that service. Maybe one could argue that ranges are exempt under the end user exemption noted below, but I would not want to bet on it.

Interestingly, while people can petition to have chemicals added to the priority toxic substance list (lines 655 to 664) it appears that people cannot petition to have them removed from the list. The mitigation/substitution plan can be challenged, but there is nothing that indicates the inclusion of a chemical on the list that results in said plan can be challenged:
676 (C) Petition for Appeal. No later than 60 days following the
677 publication of a final Chemical Action Plan by the EOEA, any ten
678 residents of the Commonwealth may file a petition of appeal of
679 any provisions of the plan with the Secretary of Environmental
680 Affairs. Such a petition may be filed if the petitioners assert that
681 the plan mischaracterizes uses of the priority toxic substance; fails
682 to include feasible alternatives, or mischaracterizes alternatives;
683 fails to result in substitution of the safest available alternatives as
684 expeditously as possible; fails to adequately address job loss or
685 impacts on existing jobs; or otherwise fails to meet the criteria of
686 this act.
Then there is the false assertion that the bill has no teeth. The proposed legislation starts with forced registration to identify the targets:
229 Section 27. Registry of Uses of Priority Toxic Substances.
230 (A) Notices. No later than 120 days following the effective
231 date of this section, any person or legal entity that manufactures
232 or distributes a product in the Commonwealth which the manufac
233 turer or distributor knows or has reason to suspect to contain a pri
234 ority toxic substance shall file a notice with the department identi
235 fying the product, the approximate number of units distributed in
236 the Commonwealth, an estimate of the amount or concentration of
237 the priority toxic substance contained in each unit, if known, pur
238 pose for including the priority toxic substance, the name and
239 address of the manufacturer, and the name, address, and phone
240 number of a contact person.
Followed by enforcement (note the use of the words "require", "regulations" and "enforcement"):
288 ...The goal of the Chemical Action
289 Plan shall be to coordinate state agency activities and to require
290 users of priority toxic substances to act as expeditiously as pos
291 sible to ensure substitution of the priority toxic substance with a
292 safer alternative, while acting to minimize job loss and mitigate
293 any other potential unintended negative impacts.
and
430 (A) In conformance with the Chemical Action Plan, the depart
431 ment shall promulgate regulations to establish substitution dead
432 lines and substitution planning requirements for business or
433 institutional uses for each priority toxic substance. The regula
434 tions shall specify enforcement mechanisms.
and
494 Section 32. Implementation — Distributors and Out of State
495 Manufacturers of Products Containing Priority Toxic Substances.
496 The department shall promulgate regulations for distributors
497 and out of state manufacturers to implement the Chemical Action
498 Plan for each priority toxic substance,
and the "all powers" catch-all in case something was forgotten:
562 (C) The department shall have all of the powers and authorities
563 necessary to prohibit or limit the use, sale or distribution of a
564 product containing a priority toxic substance in the Common
565 wealth.
all backed up with penalties:
666 (A) Penalties for Noncompliance. Except as otherwise provided
667 in paragraph B of this section, violations of sections 24 to 39 of
668 this chapter by any person or legal entity, shall subject the violator
669 to penalties of up to $25,000 per day of violation. In addition, the
670 department shall have the authority to exclude products from the
671 state when a distributor or manufacturer has failed to comply with
672 the provisions of this Act.
One might note that the following section (lines 673-675) exempts end users from penalties, but if there is no manufacture or distribution of said items then the effect of people not having access to said items is still the same.

All of this of course will be funded by new fees: Guess who ultimately pays those:
1 SECTION 5. Fee on toxic substances.
2 The department of environmental protection shall revise its
3 existing fee structure under the Toxics Use Reduction Act to
4 encompass, in addition to current filers, the wholesale sellers or
5 distributors of products or services to retail establishments in the
6 Commonwealth where such products or services utilize or contain
7 priority toxic substances, regardless of whether such wholesale
8 sellers or distributors are located within or outside of the Com
9 monwealth.
In the end this is more than just an anti-hunting, anti-gun bill. It is an omni-bus feel-good bill would result in significant governmental growth with new boards, fees, rules and regulations, and the intrusion into and constraint of free individual and market activities in the interest of socialist nanny-stateism.

Bad bill, very bad bill.

Update: Apparently the House version of this bill, which I used for the above analysis, has been pulled. The latest Senate version has been revised apparently to attempt to quiet some of the outcry. Specifically the initial list of priority toxic substances has been removed. Unfortunately, all the other problematic sections and their attendant issues remain, most of them word for word. This is STILL a very bad bill.

Serial Rat

This is a continuation of the "I'll Say It" post:

It turns out that the rat who busted Bass Pro to the Massachusetts Attorney General office, Ted at Northeast Trading Company, has a history of doing this. He's a serial rattist who will sell the gun owners of this state down the river for the almighty buck:
"Well, I do know the dealer in question. This is the third time I know of where he called the AG's office to 'complain'. First time was several years ago about duly licensed MA residents buying ammo out of state and having it shipped to them. The AG's stings followed and you know the rest of the story. Second time was a few months after the first call - complaining about duly licensed MA residents purchasing ammunition components out of state, etc. We all know what happened next. I know about these 2 calls because this dealer told me that he made them (actually the first 'call' was a meeting with the AG himself...). His reason? He was angry that he was losing sales to out of state vendors. Thats right folks. It was all about the U.S. Dollar. Had nothing to do with right or wrong. Nothing to do with integrity, etc. It was, is and always will be about the mighty $$ with him." (posted by qmmo at NES forum)
Because of his actions the legal gun owners of Massachusetts find it very difficult to purchase reasonably priced ammunition. Because of him components are even harder to find. Because of him a chance to fight the extortionate practices of the MA AG was likely squashed.

I was not calling for a boycott before, just making the info known so people could make their own decisions: Now I am. Boycott this scum-of-a-dealer. Anyone who does business with this outfit is no friend of mine. Just so you know who he is here is the address and contact information:

I'll say it

This info was initially received third hand, was confirmed by a second independent party who claimed to have written proof from the individual in question, and is consistent with hints dropped by other people who claim to have been told by this person as well. That is good enough for me.

Said shop is a ways away from me. I have never been there, but if I did happen to be in the area you can bet I will not darken their door while it is under current management.

For those of you who don't want to go read the details referenced above here's the summary of what happened:
"A dealer allegedly called CHSB to let them know what BP was doing. CHSB allegedly had the AG's office call said dealer to get further details. From what I could understand of the BP side of things (I went back there ~1PM yesterday), the AG contacted BP early yesterday morning and told them to "cease and desist", retrieve ALL guns sold that were non-compliant or face a $5K/gun fine for those sold. BP contacted all the Glock buyers yesterday morning and I was told that all were "recovered" by afternoon." posted by LenS

The dealer told me to my face that he did it and is proud of what he did. So yes, I think that if anyone broaches the subject with dealers and strikes up the conversation with the right one, he is likely to admit it.

Said dealer also told me that he was reading the NES posts on the Glocks as fast as some of the NES folks were posting them. He also told me that the AG's office was upset with ME and NES for "covering up for BP" by deleting the posts and telling folks not to post that stuff here. So perhaps (my speculation) the AG's office was reading the stuff Wed. night too (we'll never know)?

Yes, we all knew that this wouldn't last very long before being shut down, but some of us had hopes that BP was intentionally doing this to face down the AG, refuse to pay the fines which would necessitate the AG trying to file a lawsuit in a civil court, and having the court perhaps tell the AG to pound sand." also posted by LenS

Just so you know I wasn’t the first to call, nor was I the last to call. They (management at BP) were notified by more then one person and it was their decision to continue to sell. No, they were not going to and never were going to fight the good fight with the AG. As surprising as it may seem the first notification to the AG was via NES, as NES members came home after their purchase at BP they posted on NES. Lens tried as hard as he could to remove the post but the cat was out of the bag very quickly.

Hokie Spin

Recently the Virginia Tech Review Panel released their report on the Cho mass murder tragedy at VT. The AP also has a news article summary of that same report.

Looking through the actual report and then the AP news summary it is quite clear that the news summary is, shall we say, rife with factual errors. Many (most?) of the so called findings and recommendations in the news article are, at best, loose paraphrases of what the report actually says. In some cases, like their "ban guns on all campus grounds" recommendation, are flat made up. Yet another example of MSM B.S., bias and incompetence.
